Agreement

These Terms of Service ("Terms") govern your use of Realm.fun ("Service"), operated by Stubbemann UG (haftungsbeschränkt) ("we", "us", "our"). By using our Service, you agree to these Terms. If you don't agree, please don't use the Service.

Plain English version: Use our service fairly, pay for what you use, don't do illegal stuff on our servers, and we'll do our best to keep your game servers running smoothly.

The Service

Realm.fun provides game server hosting. We give you computing resources (CPU, RAM, storage) to run game servers. You're responsible for configuring and managing your servers within our platform.

Your account

You need an account to use our Service. You're responsible for keeping your login credentials secure. If someone accesses your account, you're responsible for their actions. Please use a strong password and let us know immediately if you suspect unauthorized access.

You must be at least 16 years old to create an account. If you're under 18, you confirm that your parent or guardian has reviewed and agreed to these Terms.

Payment and billing

Our pricing is displayed on our website. Prices are in Euros and include applicable VAT for EU customers. You'll be billed monthly in advance for your servers. Payment is processed through Stripe.

If payment fails, we'll try again and notify you. If we can't collect payment after 7 days, we may suspend your servers. After 30 days of non-payment, we may delete your servers and data.

Refunds

24-hour money-back guarantee

In addition to your statutory rights, we offer a voluntary 24-hour money-back guarantee on your first purchase.

If you're not satisfied with our Service within 24 hours of your initial payment, you may request a refund.

Refund requests are processed after verification of eligibility. We aim to respond within 48 hours.

This guarantee applies to first-time purchases only. Recurring payments and renewals are not covered by this voluntary guarantee.

After 24 hours, refunds are handled on a case-by-case basis. Contact us if you have concerns. Get in touch.

Right of withdrawal (EU consumers)

As a consumer in the European Union, you have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days from the day of the conclusion of the contract.

To exercise the right of withdrawal, you must inform us (Stubbemann UG (haftungsbeschränkt), Schmidt-Rottluff-Str. 3, 26133 Oldenburg, Germany, kontakt@realm.fun) of your decision to withdraw from this contract by an unequivocal statement (e.g., a letter sent by post or email).

If you withdraw from this contract, we shall reimburse all payments received from you without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw. We will carry out such reimbursement using the same means of payment as you used for the initial transaction.

Important notice for digital services: By starting to use our Service (e.g., creating a game server), you expressly consent to us beginning the service immediately and acknowledge that you lose your right of withdrawal once the service has been fully provided. If you withdraw before the service is fully provided, you will pay an amount proportional to the services already provided.

Acceptable use

You agree not to use our Service to:

• - Host or distribute illegal content
• - Run cryptocurrency mining or similar resource-intensive non-gaming workloads
• - Attack other systems (DDoS, hacking, etc.)
• - Send spam or host phishing content
• - Violate intellectual property rights
• - Resell our services without permission

We reserve the right to suspend or terminate accounts that violate these rules, with or without notice depending on severity.

Game software licenses

The games you host on our servers are developed by third-party companies and are subject to their own End User License Agreements (EULAs) and Terms of Service. By purchasing a game server hosting plan, you acknowledge and agree to comply with the applicable game's license terms.

For example, Minecraft servers are subject to the Minecraft End User License Agreement (https://aka.ms/MinecraftEULA). By hosting a Minecraft server, you confirm that you have read, understood, and agree to Mojang's EULA.

We may automatically configure your server to comply with required game license acceptances (such as setting eula=true for Minecraft). By using our Service, you authorize us to perform such configuration on your behalf, confirming that you accept the underlying game licenses.

You are responsible for ensuring that your use of game server software complies with all applicable licenses. We are not liable for any violations of game licenses that result from your actions or configurations.

Your content

You own your server data (worlds, configurations, etc.). We don't claim any rights to it. You grant us permission to store and process this data as needed to provide the Service.

You're responsible for backing up important data. While we provide automatic backups, we recommend keeping your own copies of critical files.

Service availability

We aim for high availability but can't guarantee 100% uptime. Sometimes things break, maintenance is needed, or circumstances beyond our control occur. We'll do our best to minimize downtime and communicate about planned maintenance.

We don't guarantee specific performance levels unless explicitly stated in a separate agreement.

Limitation of liability

To the maximum extent permitted by law, we're not liable for indirect, incidental, or consequential damages. Our total liability is limited to the amount you've paid us in the 12 months before the claim.

This doesn't affect your statutory rights as a consumer in the EU.

Termination

You can cancel your subscription anytime from your account settings. Your servers will remain active until the end of your billing period.

We can terminate or suspend your account for violations of these Terms. For serious violations, we may do so immediately. For minor issues, we'll try to notify you first.

Changes to Terms

We may update these Terms from time to time. For significant changes, we'll notify you by email at least 30 days before they take effect. Continued use of the Service after changes means you accept the new Terms.

Governing law

These Terms are governed by German law. For disputes, the courts of Oldenburg, Germany have jurisdiction, unless you're a consumer with mandatory local consumer protection rights.

Partner Program

The following terms apply if you participate in our Partner Program (affiliate/referral program).

Eligibility

To join the Partner Program, you must have an active Realm.fun account in good standing and be at least 18 years old. We reserve the right to reject or terminate partner accounts at our discretion.

Commissions

Partners earn commissions on qualifying purchases made by referred customers. Commission rates are tiered based on your total number of successful referrals: Starter (8%), Growth (10%), Pro (12%), and Elite (15%). Commission rates and tier thresholds may change with 30 days notice.

Attribution and cookies

Referrals are tracked using a 30-day cookie. If a customer clicks your referral link and makes a purchase within 30 days, you receive credit for that referral. The last referral link clicked before purchase receives attribution.

Recurring commissions

You earn commissions on your referred customers' payments for up to 3 months from their first purchase. Commissions are calculated on the net amount (excluding VAT and payment processing fees).

Payouts

Payouts are processed monthly via Stripe Connect. You must complete Stripe Connect onboarding to receive payouts. Minimum payout threshold is €50. You are responsible for reporting and paying any applicable taxes on your earnings.

Prohibited activities

• - Self-referrals or referring your own accounts
• - Cookie stuffing, ad injection, or forced clicks
• - Misleading advertising or false claims about our services
• - Spam, unsolicited emails, or violating anti-spam laws
• - Bidding on our brand terms in paid advertising
• - Using our trademarks without permission
• - Offering unauthorized discounts or incentives

Violation of these rules may result in immediate termination and forfeiture of pending commissions.

Partner termination

Either party may terminate the partner relationship at any time. Upon termination: (1) you must stop using referral links and partner materials, (2) pending commissions will be paid if they meet the minimum threshold and no violations occurred, (3) commissions for referred customers will continue for existing customers for up to 90 days post-termination.
